Licensing Penalties

 

Below are the civil DOL administrative penalties.  These penalties are triggered upon losing an administrative hearing, or failure to request a hearing within 30 days of the DUI arrest.  Some individuals will qualify to drive for limited purposes during the suspension period using a Temporary Restricted License After the suspension period is over the driver may be required to pass the driver’s exam for license reinstatement. 

 

Breath Test Equal or Greater than Legal Limit

 

90 day license suspension

Two year license revocation if second or subsequent administrative action within seven years

$150 reissue fee

SR-22 Insurance required 3 years upon license re-instatement

 

Refusal To Take Breath Test

 

One year license revocation if no prior administrative actions within the past seven years.

Two year license revocation if second or subsequent administrative action (refusal or breath test over legal limit) within seven years.

$150 reissue fee

SR-22 Insurance required 3 years upon license re-instatement
