THE DUI ARREST

 

We are often led to believe those Driving Under the Influence are chronic offenders constantly menacing the highways.  The local news frequently reports the tragic stories of families ruined as a result of someone Driving Under the Influence.  Hearing about these fatal incidents creates emotions of disdain, frustration and sorrow.  We believe that we would never commit the crime of Driving Under the Influence.   

 

Shockingly, a significant portion of those arrested for Driving Under the Influence are responsible citizens that never have had any contact with the criminal justice system.  How can it be that responsible citizens with no history of criminal behavior are committing this terrible crime?  We see the signs on the highway that clearly state the legal limit is 0.08.  We have heard the witty law enforcement slogans, “Driver hammered, get nailed!”  How could a responsible person commit such a crime?

 

Do you know exactly how much you need to drink to reach the 0.08 limit?  Do you know specifically how your body digests intoxicating liquor?  How does drinking on a full or empty stomach affect the processing of alcohol?  How much alcohol did you in fact consume?  When did you review the “one drink per hour rule?”

 

ONE DRINK

= One bottle of beer (12 oz.)

 

= One glass of wine (6 oz.)

 

= One "single" drink (1¼ oz. of 80 proof liquor)

Many will dine and socialize with friends and family at their favorite restaurant.  Some of those in your party, and perhaps you, will order wine or a cocktail.  Are you certain you are receiving exactly 6 ounces of wine or 1 ¼ ounces of liquor?  Does the drink you ordered have a higher alcohol content than the alcohol content the rule considers?  Many other factors can determine the outcome of your enjoyable evening.
